Terms of Service

These terms cover use of the Shipward website and purchase of the standard software recoverability audit. Follow-on work is governed separately.

Who you are contracting with

These terms are with David Boyle (ABN 93 833 832 911). Shipward is a service brand only and is not a separate legal entity.

Website and audit scope

These terms cover the public website and the standard online software recoverability audit purchase only. Follow-on work begins only under a separate quote, order form, or statement of work.

The standard audit is fixed fee, prepaid, and one-off. No ongoing support, maintenance, subscription, or auto-renewal applies unless it is stated expressly in a separate written agreement.

Pricing, payment, and GST

Prices are stated in AUD. GST is not included unless expressly stated. If GST becomes applicable, it will be handled in accordance with Australian tax requirements.

ABN is confirmed. GST registration status is not yet finalised. GST-related wording and tax invoice classification remain subject to confirmation.

Customer responsibilities, IP, and liability

You must use the website lawfully, have authority to provide any materials you submit, and avoid sending credentials, production data or logs, employee personal information, end-user or client personal information, or regulated or otherwise sensitive data unless it is separately agreed.

Shipward retains ownership of pre-existing tools, templates, methods, and know-how. You retain ownership of your repositories and customer materials. Audit outputs and standard templates remain Shipward-owned, with internal-use rights for your business.

Shipward may suspend or refuse service for non-payment, unlawful or unsafe conduct, security risk, outside-scope activity, or legal or compliance reasons. To the extent permitted by law, liability for the standard audit is limited to the fees paid for that audit, and indirect or consequential loss is excluded.
